Megan's Law
Megan's Law is named after seven-year-old Megan Kanka, a girl who was raped and killed by a known child molester who had moved across the street from the family without their knowledge. Currently all 50 states have either a law enacted or are proposing Megan's Law which requires the registration of all people convicted sexual crimes because sex offenders are more prone to re-offend and it assists in protecting the public. Of those who had been convicted of a sex offence against a child not a part of the offenders family, after 4 years 3 out 33 - 9.1% - had been reconvicted of a further sexual offence, and after 6 years 5 of a sample of 19 - 26.3% - had been reconvicted of a further sexual offence. (sex) The cases of E.B. v. Verniero, Doe v. Patacki, and Roe v. Office of Adult Probation have all tested the ethic boundaries of releasing information on convicted sex offenders and kidnappers. Only a fraction of those who commit sexual assault are apprehended and convicted for their crimes. Most convicted sex offenders eventually are released to the community under probation or parole supervision. Rapists that were released were found to be “10.5 times as likely as non-rapists to be re-arrested for rape.” (Legal) Of those individuals that had been incarcerated for sexual assault they “were 7.5 times as likely as those convicted of other crimes to be re-arrested for a sexual assault.” (Legal) Statistics on the “recidivism rates among sex offenders vary widely according to the crime.” (Christian) Those involved in familial assaults “re-offend at rates of 6 to 10 percent, repeat rapists at 39 percent, and predatory pedophiles at 52 percent.” (Christian) Studies have shown “reliably that for 'serious' sexual offenders released from prison, 5% are reconvicted in the first four years after release.” (Sex) If this were averaged, it would mean a “5 year reconviction rate of be about 6%.” (Sex) This would mean if we applied the same principal that on average sex offenders re-offend after release “about 9-10% after 21 years.” (Sex) That would average to a “reconviction rate for sex offenders released from prison … May therefore be about 12%.” (Sex) • Deters sex offenders from committing new offenses;
