Erotica Pornography in American Society

Rape is an extremely violent act that is very prevalent in American society. Somewhere in America, a woman is sexually assaulted every 2 minutes. In 1996, 307,000 women were the victim of rape, attempted rape or sexual assault, and between 1995 and 1996, more than 670,000 women were the victim of rape, attempted rape or sexual assault [National Crime Victimization Survey, Bureau of Justice Statistics, U.S. Department of Justice, 1997]. In 1996, only 31% of rapes and sexual assaults were reported to law enforcement officials - less than one in every three. By these statistics more then 1 million violent sexual acts are taking place within our society every year. Many causes can be argued for the statistics but I believe that by making certain types of pornographic (erotica) material illegal, it would decrease the amount of victims in our society.

What is the definition of pornography? Pornography stems from the Greek words for porno, meaning prostitutes, and the word graphos, meaning writing. “The Carnegie Mellon Pornography Study" (http://venus.soci.niu.edu/~cudigest/rimm/rimm.html) adopts the definition utilized currently by pornographers. Pornography is defined to include the depiction of actual sexual contact ("hard-co


The topic of pornography is the one that elicited the most emotion from me when we where discussing it in class. I found that this hit home more then other topics because a friend of mine was raped. I feel that any depiction of the same acts for sexual gratification of anyone is wrong. For someone to be sexually turned on by rape or other violent sexual acts should be considered a disease. I find those types of acts to be analogous to pedophilia. The depiction of children in sexually depicting acts is illegal in our country and looked at as extremely wrong with in our society. This topic affects our entire society and should be seriously looked at again by our government.

By those requirements all pornography that depicts violence or demeaning acts (erotica) should be illegal. According to the argument by Reid D. Albee “Ethical Considerations of Pornography”, “Law enforcement officers and prosecutors attempting to pursue an obscenity investigation or prosecution face constitutionally mandated procedural obstacles not present in other criminal matters. (New York v. P.J. Videos, Inc.) For instance, the "plain view" exception to the Fourth Amendment warrant requirement, whereby contraband plainly visible to a law enforcement officer may be seized, does not apply to allegedly obscene material because, prior to a judicial determination, nothing is obscene and therefore, a fortiori, nothing can be considered contraband.” Those requirements create difficulty in determination of Erotica and cause the judicial and criminal system to struggle with finding and eliminating Erotica. With many different types of pornographic media available today, the internet poses the largest threat to society. Massive amounts of pornography have flooded the internet and it is currently one of the largest active internet industries. The table below gives an idea of the amount of internet pornography.

Many arguments against the regulation of pornography say that there is no connection between violent pornography and sex crimes. Looking at the Case of Theodore Robert Bundy (AKA Ted Bundy) who was assistant director of the Seattle Crime Prevention Advisory Committee, wrote a pamphlet about rape prevention and was responsible for raping and murdering 50 young women. Hours before his death Bundy told psychologist James Dobson about the effects of pornography on his life. Bundy claimed he began by reading “soft-core” pornography at the age of 12. He and his friends would often find pornographic books and magazines in garbage cans in his neighborhood. He soon began reading “hard-core” pornography and claimed that pornography eventually became a "deadly habit" to him.
