USA Patriot Act
In late 2001, Congress passed a new act. Its name is the USA PATRIOT Act. It stands for Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism. When this act appeared before Congress, it passed without amendment and without even the pretense of debate. The vote only had one opposing viewpoint. After September 11, 2001, the government was tossing around ideas, which led to this act. The purpose of the act in itself is extremely good for the well-being of America, but its purposes are taking away rights that the constitution promised the people of America. Under the USA PATRIOT Act, the FBI and CIA are able to abridge the established civil liberties, monitor computer usage and library transactions, and jail American citizens indefinitely without counsel and without a charge brought against them. This act is letting the government do what ever they want and completely disregard the Constitution. The act meant to help prevent terrorism. It accomplished this by listening to tips that people had about possible terrorist and then investigating. This in itself sounds wonderful but once the action started in it became horrible. The government then had th
e right to enter someone’s house, work, car, and any other places where they suspected that terrorist information could be hidden. When they entered a place, they had the right to go through whatever they wanted and take whatever they wanted. They also do not need a warrant or approval from anyone. They could enter someone’s house while the person is not home, search through their things, then later come back, and arrest that person. Now let us follow what will happen to the arrested person. After being arrested, he will be designated as an enemy combatant and would be held indefinitely without charge and without the benefits of due process. Now when a lawyer was called (most likely by the family of the arrested person) he would not be allowed to speak to his client at all until they were present at the trial. The lawyer would not be allowed any contact with his client. If he wanted to appeal to a judge to override the government’s decision of taking away Americans undeniable rights, the government would tell him that he needs approval from his client to appeal and he cannot get it because the lawyer cannot have any contact with his client. The end situation of this will be that the arrested person will most likely spend as much time as the government wants in jail.
