Legal system began to change its convictions about “separate but equal” and whether or not it was unconstitutional. In the interim of Plessy v. Ferguson and Brown v. The Board of Education the supreme court became influenced by other separate but equal court cases and this lead to their decision in Brown. The specifics given in the evidence of their treatment give great examples of how the treatment African Americans was unjustified.

One of the major points was the transition of the verdict from Plessy to Brown. Plessy was used for more than sixty years as a precedent for other segregation law cases. It is obvious that WWII played a huge role in the changing sentiment in the courts as well as society. Another major point that played a huge role in the decision of the Brown v. The Board of Education were the arguments made by the plaintiffs. The arguments were not based on equality but the unconstitutional basis of the segregation laws, unlike cases before theirs. There is evidence in the Amicus Curiae briefs and actual court arguments in the Plessy v. Ferguson case and the Brown v. The Board of Education case.
