U.C.M.J.

The Uniform Code of Military Justice (U.C.M.J.) governs the armed forces. If a solider breaks a law then he will be subject to the punishment of the U.C.M.J. President Truman enacted the U.C.M.J. on May 31, 1951, so that it would bring all armed services under a unified system of justice. The Code is of great importance to all members of the armed forces. It explains the legal responsibilities of the armed service members and it also states the legal requirements. The Uniform Code of Military Justice has been amended on a few occasions, and all of the amendments have been designed to ensure even greater protection of the individual rights of each service member than were stated in the original code of justice. The purpose of the U.C.M.J. is to provide a uniform application of protection and to assure safeguards in a system of justice for all members of the Armed Forces.

The U.C.M.J. is found in Title 10, Chapter 47 of the United States Code. Servicemembers, active and reserve who must follow th code, of the Army, Navy, Air Force, and Marine Corps; as well as U.S.M.A. cadets and U.S.N.A. midshipmen. Some of the revisions that the U.C.M.J. has gone through started to really occur after Vietnam. The government saw that the Uniform Code had to be changed: “The military Justice act of 1968 replaced the law officer with a military judge, an attorney selected by the service’s judge advocate general. In the Justice act of 1983 eliminated command control over military judges by not allowing the convening authority to designate the trial judge of a particular case” (Office of the Army 23). The U.C.M.J. is starting to make reforms but it still has a long way to go.

One of the most notorious displays of military justice in modern times occurred after twenty seven young soldiers imprisoned in an Army stockade in San Francisco broke formation at the work line-up on the morning of October 14, 1968 sang songs and demanded to see the press, to see lawyers and to have and audience with the stockade commandant.
