In order to find the people or companies that we would like permissions from, our company could do one of two things. First, we could find the companies or individual's phone number and call and ask about it or set up a formal meeting in order to discuss the graphics use and intent. Second, if a meeting or phone call isn't possible, then we may choose to e-mail or send a letter explaining what we are doing with the specified photograph or graphic and asking for a reply in return with permissions and any boundaries that company or individual has set within copyright limitations.
As part of a partnership photography studio with a small, business approximately a half hour outside of Pittsburgh, we needed to be careful of the name and the design we chose for it. We decided on the name Unique Photography written in a custom font. The issue was trying not to infringe on any company trademarks already in existence.
The first issue my partner and I had to deal with when opening up our own photography studio was that of trademark infringement. When choosing a name and design, we could not choose anything that would be confused with another studio. The reason for this is so that we do not "taint" another studios" name or illegitimately take away their current customers. After deciding on the name Unique Photography, it was up to me and my partner to find out its validity for commercial use.
First, what we did was search the U.S Patent and Trademark Office online at www.uspto.gov/main/trademarks.htm to make sure that first it wasn't already a registered trademark. When finding out the name and chosen design were not already registered, we then searched to find if there were any other photography studios with a trademark that was very close in similarity, so much that the two could be confused. After an extensive search, we found no other company with our planned trademark or overtly similar marks.
