The Judiciary Branch


Without the role of the judiciary, both the legislative and executive branch would pass laws that they believe are constitutional when in reality, they are not. Therefore, the judiciary's power of judicial review is essential in maintaining impartiality between the branches. .
             Moreover, the judicial branch is the only branch to possess lifetime tenure. Lifetime tenure within the judiciary is said to be "one of the most valuable of the modern improvements in the practice of government " (Federalist 78). I think that lifetime tenure is an important component in our government because it is another check within our three branch system. For example, lifetime tenure protects the judiciary from political pressures. Hamilton states, "As to the tenure by which the judges are to hold their places; this chiefly concerns their duration in office; the provisions for their support; the precautions for their responsibility " (Federalist 78). Lifetime tenure is vital for the success for the judiciary branch and for our government overall. The tenure of the judges affects all aspects of their duties as an appointed justice. Without lifetime tenure in the judiciary branch, this branch would be insignificant within the checks and balances system. This is because the judiciary's main role is to declare action and laws as unconstitutional. However, if the justices were bothered with the pressure and stress of an election, their decisions would be swayed in order to win the election. It is important that the judiciary "secure(s) a steady, upright, and impartial administration of the law " (Federalist 78). Elections within the judiciary branch would not permit them to do just that and the people would not be able to trust them to be neutral in their judgments. .
             Furthermore if the judges were to be appointed on a regular basis, it would position additional power to either the executive or legislative branch.
