If the juvenile committed the offense in another state and was adjudicated delinquent, and if that offense was equal to the statute in Title 21 of the Oklahoma Statutes the juvenile transferred to Oklahoma must register. Juveniles who have committed the offenses listed in Title 21 no matter when, have to register in the state to which they transfer. .
Office of Juvenile Affairs Registry.
The Office of Juvenile affairs creates and maintains the registry for the juveniles who are required to register as sex offenders. The registry includes fingerprints, photographs, and personal information from forms; this information may or may not be released to law enforcement agencies or to the public before the issued court order. The Office of Juvenile Affairs also distributes the rules and procedures for the Juvenile Sex Offender Registration Act. .
The District Attorney's Application.
When a person qualifies as a juvenile sex offender, the district attorney may file an application to include the juvenile on the registry. The court will then appoint two qualified licensed professionals (psychologist or physician) in the treatment of sexual offenders to evaluate the juvenile and report to the court the treatment prognosis, and if the juvenile presents a serious threat to society. After careful evaluation of the prediction of the licensed professionals, the court will decide whether the juvenile presents a risk for being a serious threat to society. If the court feels the juvenile is a serious threat to society, then the court will order the juvenile to register. At that time, depending on the seriousness of the prediction, the court may use discretion to release the information to the public. .
Duty to Register.
Prior to adjudication, when the court orders a juvenile to be registered on the sex offender list, the court must provide, at the time the order is written, a notification of the duty to register.
