However, if a juvenile is given a sentence as an adult, they should serve the remainder of their juvenile life in a juvenile detention facility before being transferred to an adult prison.
In the United States, there was always one court system for all crimes. It was not until July 1st of 1899 in Chicago, Illinois that the first juvenile court was established. By 1945, every state had passed some kind of separate juvenile court. These courts defined themselves with a two-part purpose. One, to remove children who commit crimes from the ordinary criminal courts to separate courts which consider the child rather than the crime. Two was to have the juvenile court provide protection and treatment to other children who needed it (Vedder 143-146). The purpose, however, was not the result. Juvenile courts have not done an adequate or consistent job of punishing juveniles. In 2000, The Justice Institute of California studied some of the areas of consistency in the juvenile court. They found that minorities compared to whites are 2.8 times more likely to be arrested for violent crime, 6.2 times more likely to appear in the adult courts, and seven times more likely to be sent to an adult prison (Vasudevan 105). The juvenile court must have a basis of equality and fairness. But 62% of all juvenile inmates in 2001 were minorities (Flowers 170). Although the juvenile courts cannot decide who is and is not arrested for their crimes, they can erase the fact that minorities are more likely to appear in adult courts and that they are more likely to be sent to an adult prison.
