             Human evolution has seen the acceptance of natural rights and human rights that every individual is born with. These rights cannot be removed, distorted, suspended or denied. All human beings are born free and equal in dignity and rights without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status. If communities (in Australia) are to redraw the balance between individual rights and rights of the community some individuals will lose their liberty, liberty which is guaranteed by the Rule of Law, liberty which every individual has the right to. A government in violation of the Rule of Law cannot function.
             1 The Rule of Law.
             Government must function under the Rule of Law if the rights of the people are to be respected and upheld. Rule of Law or government under law: "The government must be bound by substantive law, not only constitutional, but also as far possible by the same laws as those which bind the individual." If law does not limit or constraint the powers of government, it may degenerate into the implementation of oppression. Once the liberty of an individual is lost the government has crossed the boundaries of the Rule of Law. The liberties of whole communities will eventually be removed, due to the lack of limits on power that the government can utilize, that government is approaching an authoritarian regime where there is no freedom, no human rights. An example of this would be German statutes of the Nazi period, that anything is punishable if it is deserving of punishment according "to the fundamental conceptions of a penal law and sound popular feeling.
