The American Criminal Justice System


This all has to do with media and how they portray those being accused. The "Casey Anthony" trial is notorious for this. A majority of Americans and an overwhelming portion of the media had convicted her before the trial. Even after all of this speculation of her being guilty, she was found not guilty. This decision was made by twelve jurors. After, some of these jurors were interviewed and said they thought Casey Anthony was guilty. So why would they let someone go who they thought committed the crime? This has to do with another part of the American Criminal Justice System called "beyond a reasonable doubt." This is according to the dictionary "the standard of evidence required to validate a criminal conviction in most adversarial legal systems. Generally the prosecution bears the burden of proof and is required to prove their version of events to this standard." So, if a prosecutor cannot provide sufficient evidence strong enough to make a conviction, you cannot convict someone of a crime. .
             From the verdict at the end of the trail to the very beginning, the process that is followed is routine. There are eleven main steps to one's journey through the American Criminal Justice System. The first step of the process is when a crime is thought to be committed. Once a crime is thought to have occurred, an investigation will go on by law enforcement. During this investigation, they will gather evidence and rule out suspects. Once there is a sufficient amount of evidence and probable cause a person can be arrested. Probable cause like beyond a reasonable doubt has to do with standard of proof. Law enforcement cannot just go through all your belonging if you are suspected though. A warrant must be issued to search one's personal belongings and probable cause needs to be present for this.
             The second part of this process is the arrest. When someone is arrested he or she must be read their Miranda Rights.
