             At the outset the Plaintiffs have filed the present suit against these Defendants with a malafide intention only with a view to harass them & usurp the suit premises which is in the possession of these Defendants since the year 1938. On this count only the suit is liable to be dismissed.
             2. At the further outset by filing the present suit the Plaintiffs want to pressurize these Defendants to quit, handover the vacant possession of the suit premises on this ground also the suit is deserves to be dismissed.

With reference to paragraph no. 3 of the plaint, these Defendants deny that in breach of the terms of tenancy & in breach of the provisions of the Maharashtra Rent Control Act, these Defendants have carried out unauthorized extension, additions & alterations to the suit premises and have put up a permanent structure thereby causing waste and damage to the suit property as falsely alleged by the Plaintiffs and put the Plaintiffs to strict proof thereto. It is pertinent to note that the Plaintiffs have not given the particulars of the alleged illegalities carried out by these Defendants which clearly show that the Plaintiffs approach towards the matter is absolutely casual and not bonafide. It is also noteworthy that the Plaintiffs have not brought before this Hon'ble Court the terms of tenancy which according to the Plaintiffs have been violated by these Defendants.
