"The mother's alleged fault or wrongful conduct is irrelevant under section 545 of the Family Court Act. The primary purpose of a paternity proceeding is to protect the welfare of the illegitimate child and, accordingly, the mother's conduct during intimacy should have no bearing on the father's duty of support nor upon the manner in which the parents' respective obligations are determined" (Pope, 1998).
The court also agreed that Shane is to have no visiting rights and must pay the KDSRS the $7,000 dollars owing from aiding the child's mother through her court journey as well as monthly allowances for the child. Colleen Hermesmann never served for her crimes. It was in 2011 that Shane spoke up about his horrific journey and asked for help, but then, the case has been stagnant. Similarly, in 2014, Nick Olivas was called to court with a surprising charge. More than 5 years before, Nick, who was 14, and a mentor of his, who was 20 had an intimate sexual relationship that was terminated abruptly when Nick was alerted to the fact that his mentor was becoming more and more mentally abusive to him and using him for her own advantages. For 5 years, Nick heard not from his mentor and continued throughout life normally. In October 2014 however, Nick received a notice from The Arizona Department of Economic Security Division of Child Support Services (ADESDCSS) (A-Dess-Diss) who had tracked him down after his mentor had filed for child support nearly 6 years after the birth of their child. According to the woman, when she left Nick, she knew she was pregnant and simply chose to ignore him to stop further complications and legal charges. Arazona officials used information gathered from the mother and found Nick, compelling him to pay around $15,000 in child support, as well as the hospital bills for his daughter's birth, with 10 percent interest added on top.
