Teachers and Non-Delegable Duty of Care


            In today's society, people employed into the workforce must all abide to certain regulations and laws according to their corresponding work duties, enforcing those associated to follow and perform accordingly. In South Australia, there are regulations which were formed for people who are employed to work with children and youth. These regulations are implemented to give those employed; the responsibility to "take reasonable care to avoid acts or omissions which [they] can reasonably foresee would be likely to [injure people]" (Raniolo,R.). .
             Essentially, the purpose of a teacher is to make each individual student want to succeed and inspire to achieve their goals in life. Teachers must provide an environment which each student feels comfortable in for them to develop social and learning skills. They also need to be effective in their role as to structure the learning program to facilitate different types of students and acknowledge their learning capabilities, but to also maintain responsibility for student safety. In order for a teacher to exercise student safety properly they must acknowledge the legal law of duty of care. .
             Duty of care is in relation to the Children's Protection Act 1993 and Children Protection Regulations 2010. The purpose of the act is to legally protect and ensure a child or youth's safety and wellbeing whilst being in the supervision of a teacher or employed worker. The act clearly enforces "to ensure that all children are safe from harm; and to ensure as far as practicable that all children are cared for in a way that allows them to reach their full potential" (Children's Protection Act 1993). .
             School authorities also owe a non-delegable duty of care which is carried out to ensure that the proper measures are taken in a reasonable circumstance, in order to protect a student under their care from any risks of injury that the staff member should have reasonably foreseen.
