Partial Birth Abortion Act


             President Bush has just signed a ban on late-term abortion. To many this might means nothing, but a closer look at this issue and it relates to all of us because it infringes on our God given rights and the rights given to us by our founding fathers of the Constitution. .
             Back in the 1970s the U.S. made it certain that not allowing a woman to a legal abortion violates a woman's constitutional guaranteed right to privacy. The Supreme Court found that through the Bill of Rights as applied to the states through the Fourteenth Amendment in the case of Roe v. Wade (1973). Even then, during the third trimester of pregnancy abortion was still legal to save the life or health of the mother. .
             Now President Bush has signed and passed what other presidents vetoed. The ban outlaws "overact" abortions. It also gives no exception to whether or not the mother's health is at risk or if the fetus will be born with harmful ailments. This goes against our specific rights found in the Bill of Rights, that include the First, Third, Fourth, Ninth, and Fourteenth Amendments. The Amendments are rights of ours that should be carried out by equal protection right and due process of the Fourteenth Amendment. A Nebraska federal judge questioned the law's constitutionality and even issued a limited temporary restraining order against it. The U.S. District Judge Richard Kopf said he was concerned that the ban contains no exception if the woman's health is at risk as he issued an injunction applied only to the four doctors who brought the suit, according the CNN.com article. .
             Whether or not I personally believe with abortion is irrelevant, but I do believe that as citizens of the United States of America we all have rights. If a woman or a man wants to do something with their own body, they have the right to since it is their body and not the government's body. So with the signing of the Partial Birth Abortion Act it definitely takes away our right, and it is unconstitutional.
