I asked him to explain the fuel level and he could not.
Most of my attention was focused on the driver with the intent on determining his evolvement in the offense. Once I observed the passenger Javaris Dawsey, I believed he was the perpetrator in the theft. Dawsey's clothing was an exact match to the clerks description With this information I believed a show up line up would assist in the resolution of this case. I contacted the clerk on my personal cellular telephone and asked her again to describe the suspect. The information was an exact match so I asked her to come to my location to identify the vehicle and suspect. She stated she was available to respond, so I had D/S Chamberlin respond to the clerks location for transport. .
Before the clerks arrival, I asked the driver to step out of the vehicle. Once out of the car I continued questioning him further. I asked how long had he been with the passenger and he replied, he had just picked him up from his house where he was sleeping. I explained to Tatum the vehicle he was operating was observed just leaving the gas station with out paying for gas. I asked him to explain that and he only replied, well it wasnt me. I asked him who committed the offense and would not answer.
The clerk was brought to the location of the traffic stop. When she arrived I was conducting my interview with the Tatum. Her immediate words to D/S Chamberlin were, that is the car but that isnt the driver. She replied you got the right car but the wrong driver. D/S Chamberlin asked the passenger to step out. When the passenger exited the vehicle she replied thats him. She was asked if she was sure and she was positive that Dawsey was the operator at the time of the theft. She stated she clearly observed him while pumping gas because once he finished pumping, he held up his hand to portray as if he needed a minute to retrieve his wallet from the vehicle. She stated this was normal so it did not alarm her, however, when he reentered the vehicle he took off.
