Abortion in Canada was decriminalized on January 28, 1988 following the trial of Dr. Henry Morgentaler, when the Supreme Court of Canada declared the old abortion section of the Criminal Code unconstitutional. In May 1990, the House of Commons passed Bill C-43, legislation to re-criminalize abortion. The new law would have made abortion punishable by up to two years in jail unless a doctor determined that continuing a pregnancy threatened a woman's physical, mental or psychological health. Bill C-43 was defeated by the Senate on January 31, 1991. There remains no federal abortion law in Canada.

Killing an unborn baby through abortion is no different from killing a born baby which is no different from killing a two year old.
