State Abortion Controls


Just recently, a federal court lifted Arizona's ban on abortions after 20 weeks of pregnancy. It was agreed that this law interfered with a woman's entitlement to an abortion given to them by the Constitution. .
             According to Judge Marsha Berzon, "such bans before viability violate a long string of U.S. Supreme Court rulings starting with the seminal Roe v. Wade decision in 1973 (Elias). She also said that "a woman has a constitutional right to choose to terminate her pregnancy before the fetus is viable"(Elias). State's rights should never supersede those granted by the Constitution. Abortion is an issue of choice in terms of one's own body, not an issue of murder. Therefore, individual states should not have the right to establish their own laws regulating or forbidding a medical procedure of any kind, including the controversial practice of abortion. .
             The federal government should remain true to its legalization of abortion since the 1973 case of Roe vs. Wade. Justice Harry Blackmun was accurate in noting that it would be unconstitutional for someone to parade on the rights of women and their decision to abort an unborn baby. There are multiple cases where abortion is the better choice to be made; one being an incident where a female has been raped and does not wish to carry the child of an unfortunate situation. In this case, women can take the pill or go through early medical procedures that will remove the fetus or embryo from the womb of the woman before it has reached a stage of potential self-sufficient life form which can be possible between the twenty-second and twenty-fourth week of pregnancy ("Abortion "). .
             In addition to this, there are instances where the impregnated tissue which is supposed to turn into a fetus can become swollen and infected leading to a disease harmful to the woman known as a molar pregnancy. Many might say this situation is different because it did not actually become a baby, but those who insist life begins as soon as the sperm is planted into a woman's egg would then have no explanation behind the molar pregnancy.
