While yes, a schools funding, the environment the students grow up in, etcetera, are factors in student's learning, any other job faces challenges, and an apt teacher would be able to overcome this. If teachers are given all the praise for a student's success why would a teacher not also be to blame for a students failure? Some teachers are simply not cut out to teach, or they have possibly lost their passion to do so, regardless of the reason, ineffectual teachers need to be able to be removed from their positions. .
Not only does the controversy surrounding the teacher tenure policies in California bring up discussion, it also holds its own when one considers the fact that it does infringe upon the constitutional rights of the students. The California state constitution makes it a civil right to receive an education. Teacher tenure is a violation of the rights of the student because if a teacher cannot teach properly, then the student is not receiving an education. Students are definitely realizing this as well, "a group of student argued that state tenure laws had deprived them of a decent education by leaving bad teachers in place"" (Medina 1). Once a teacher has achieved tenure, they are no longer subject to evaluations that in the past they may pass due to past satisfactory teachings, but education is highly evolving and said teacher may no longer be fit to work such a position. The teacher unions and other advocates for teacher tenure argue that This is a huge problem that is recognized by the courts, "the court emphasized several times that one of its chief concerns was the retention of "grossly ineffective teachers"" (Watts 1). Many argue that the courts are trying to favor the rich and the wealthy, but this is just an excuse to veil the matter at hand; that some teachers are simply ineffective and need to be removed. Teachers are very important to our society; therefore they should be able to prove that with their evaluations.
