Discretion


The fact that we as human beings are ruled through our freedom seems to be a central claim of governmentality studies (de Lint 1). Discretion takes our rights away by limiting us to specific characteristics such as "urban" clothing might make someone look like a thug but in reality could be a straight A student who chooses to dress that way. What this grouping does is make police put people in categories and maybe might pull over a car with specific characteristics such as tinted out windows when they have done nothing wrong and officers might use the excuse of a "failure to use a turn signal" just to see who is in the vehicle and what they are doing. In this essay we will attempt to explain what discretion is, how it is applied on a daily basis, and what problems it solves and also the ones that it brings up.
             Police discretion exists when officers have some leeway or choice in how to respond to a situation (Dunham & Alpert 119) But police discretion could also exist in situations when an officer might opt to not respond or make an intervention. For example, an officer pulls over a women for traveling fifteen miles over the speed limit on a very densely populated road, and after approaching the vehicle notices that this particular female offender is rather attractive, and then decides to let her go because of this. This could be due to a variety of different reasons, possibly this officer is single and is looking for a life partner or maybe they might have gone to high school together. The problem here is that the officer has some connection either from the past or possibly an attempt for a future relation, in turn making the police officer probably not give a ticket where maybe they would if it was someone that was unattractive and that they didn't know. It really doesn't matter what the reason is because no matter what personal elements makes up the officers mind if there was a different reaction or response due to the fact that the violation involves a different person or circumstance it is ethnically wrong.
