When Ned returns home from prison years later, he soons realises that nothing has changed when he finds a police officer (Fitzpatrick) forcing himself on his Ned's sister. Ned soons finds out that Fitzpatrick came to the family home, located in: and once again forces himself on Ned's sister, the brothers defend their sister from Fitzpatrick, but are accused of shooting him, all this happened while Ned was in a barn with Julia Cook (Watts) but Fitzpatrick had another story and said that Ned was there while all this was going on. There is no evidence today still, to say where Ned was that night. Ned's family are persecuted for what they had supposedly done, and Ned's Mother is thrown into prison. .
Enraged by the incarceration of his beloved mother, Ned declares war on the authorities and shows he is willing to stand up to them. Along with his best friend Joe Byrne (Bloom), his brother Dan Kelly (Laurence Kinlan) and another friend Steve Hart (Philip Barantini) the wanted men flee from their hometown. Forced into supporting themselves as outlaws, they head into forests, which is where the fatal police shooting occurred.
This scene is very dramatic, Ned and his gang being hunted down by the Victorian police. When the police notice it is the Kelly Gang shots are fired - Ned in defence of himself and his family shoots back. This is the first scene in the movie when you are able to see that Ned is going to stand up for his family and his own rights, and will kill to do so. I noticed that Ned never shoots first which shows once again that he is portrayed as the good guy who is only shooting for self-defence. Ned is distraught after shooting one of the officers in the neck, the man is crying out for help! Ned knows what he has to do, and shoots the man to relieve his suffering. This is one of the more emotional scenes as you get to witness how Ned is feeling after what he had done. .
The then, most wanted man in Australia, Ned Kelly and his gang, begin travelling from town to town robbing banks like those in Jerilderie and Euroa, and holding townsfolk up as they go - "I am a widows son outlawed and my orders must be obeyed", Kelly explains while holding up one of the banks.
