The Modern Day Struggle of Aboriginals


This is true of many early contact treaties made between Europeans and native peoples. These treaties would be to the disadvantage of native people in later decades but it did leave them with one key factor that would ultimately be there saving grace. The very signing of treaties designated aboriginal tribes and people as sovereign states. This would play a key role in every law and legislature to be made according to aboriginal rights in Canada in the future. .
             In 1763 New France was ceded to the British Crown. Soon Britain found themselves trying to deal with the dissatisfactions of Native tribes in the Americas and attempting to gain the trust of their new Native population in New France. This was a Native population who were largely allied with the French prior to British control. King George III "s response to the overwhelming addition of New France to Britain's North American territories was the drafting of The Royal Proclamation Act of 1763. The Proclamation is a document that lays out many new laws, provisions and codes. The Quebec constitution lye's in the Proclamation as well as colonial boundaries but the part concerning aboriginal rights lies in the introductory preamble. The preamble clearly states, "Indian nations are autonomous political units living under the Crown's protection and would retain their internal political authority and their territories. These territories should not be granted or appropriated without Indian consent".2 The Proclamation in effect set aside a large chunk of land for Natives. It reserved it as their hunting ground, prohibited grants or purchases of Natives lands without their consent. The Royal crown or a proprietary government under instruction of the crown were the only bodies able to purchase these lands from Natives. In addition to rights to lands Indians were granted protections such as restrictions on trade. After the proclamation the only people able to trade with natives were those who had a license.
