Malpractice


            Medical malpractice insurance covers doctors and other professionals in the medical field for liability claims arising from their treatment of patients. Initially there was very low occurrence of doctors who were sued in the 50's, 60's and 70's, due to malpractice. Malpractice insurance was optional to purchase and a lot of doctors did not chose to carry it. The common price for insurance in the 60's was a couple thousand dollars a year for millions of dollars of coverage. Over the years there were laws introduced by attorneys that made medical malpractice insurance mandatory. Many states felt that this was for the benefit of the patients who were wronged. At that point the amount of insurance premiums increased the number of law suits increased and the amount of judgments increased. In the last 10 years in Florida the rate of malpractice insurance for a specialist has gone from $6,000 to $8,000 in 1990 for one million to three million dollars coverage, to $18,000 in 1995, to $24,000 in 1999, to $36,000 in 2001, and to $105,000 in 2003. At this point the purchase of malpractice insurance is extremely expensive to the physician. The inability to pass cost of business to the patient because of fixed HMO fees, reduced fees for Medicare, and the incapability to get cash paying patients, means that doctors are receiving very high cuts in their income, and are facing higher risk.
             Indeed, large targets are now being painted on doctors and the numbers of suits are growing uncontrollably due to the unreasonable large settlements, in hopes of garnishing the 40% recovery for the attorneys. Attorneys are now advertising in a lucrative practice and advertising has increased 100 fold. The law board and bar are against this lucrative advertising, but there as been no law put in effect to stop it. Currently, many patients are finding it difficult to find doctors and doctors are finding it difficult to find insurance.
