Categories of Murder


            The word murder is one of those words that give you the chills just because of how common the crime has become in today's society. Murder is defined as the unlawful premeditated killing of one human being by another. An important fact about murder is that murder falls under the category of homicide crimes. Murder can fall into two offenses which our first degree and second degree murder. First degree murder in most states is defined as a unlawful killing that is Willing and premeditated. This means that the murder was committed after being planned and waiting for a specific time to approach the victim. A good example is Jonathan comes home to find his wife in bed with the neighbor Richard. Jonathan is highly upset and is losing his mind and three days later Jonathan weeds behind a car parked in front of Richards front door and when Richard comes out, Jonathan suits Richard 3 times and kills him instantly. I believe that is a perfect example of first-degree murder.
             Second degree murder from my understanding can be defined in two ways. The first type of 2nd degree murder is an intentional killing that is neither planned nor premeditated. The second type of 2nd degree murder is a killing caused by dangerous conduct and the offender's obvious lack of concern for human life. That type of 2nd degree murder is usually viewed depending on the circumstances anywhere around first degree murder and voluntary manslaughter. A good example of second-degree murder is Jennifer comes home to find her husband in bed with her classmate Victoria. Jennifer is highly upset leaves her house and the next day on a red light on Central Avenue Jennifer realized Victoria writing in the passenger seat of her mother's car. She then pulls out a gun and fires four sides into the car missing Victoria but unfortunately she kills the driver of the car. I asked my uncle who is a police officer in Jersey City about murder and he said if a murder does not qualify by statute for first degree murder, it is charged as second degree murder.
