The Government and Gun Control


The government's move to strengthen gun control laws will lead to a violation of the 2nd Amendment of the Constitution that states. "A well-regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed" (Carter 525). As envisioned in the provisions of the 2nd Amendment, every individual has a fundamental right to keep and bear arms without being denied the right by the state or any institution. In other words, all American citizens are allowed to keep and bear arms and carry guns or arms for self-defense. Although the 2nd Amendment does provide the federal government authority to regulate the issuance of arms, it does not mean that the state has discretion to violate the rights of the citizen. In essence, the provisions of the 2nd Amendment create a balance that safeguards rights of citizens and also allows the government to reinforce gun control laws. However, this stability will be interrupted when gun control laws are strengthened because it will mean that many people will not be allowed to possess and bear firearms for personal defense and security reasons as before. Currently, the gun control laws only prohibit individuals who have mental challenges and have criminal records from purchasing, keeping, and bearing arms, but other people (without these mentioned constructs) may be infringed their right to bear, keep, and purchase arms when the government implements this idea. Therefore, the government should not strengthen gun control laws because it will become a violation of the Constitution.
             Although, the federal government has formulated and enacted gun control laws, the high number of firearms in the hands of lawbreakers and unstable individuals has fuelled gun violence. Also, it has increased death toll of innocent civilians who die as a result of gun violence crimes such as suicides, homicides, and unintentional shooting.
