There have been many landmark cases in the history of the US that have expanded the powers of Congress. McCullogh v. Maryland was a case that helped Congress create the Second Bank of the United States. This case said that the constitution needs not expressly empower Congress to create a bank. This Second Bank was good to the execution of borrowing, taxing, currency and commerce powers.
With the case of Gibbons v. Ogden, Congress was allowed to expand their power within interstate commerce. Their powers had elongated with the elastic clause and implied powers. The court ruled that commerce includes "services" and not only does it apply to tangible goods. .
With the case of South Dakota v. Dole, Congress" powers expanded. The exercise of the spending power can now be in pursuit of the general welfare. Conditions on federal grants might be illegitimate if they are unrelated to the federal interest in particular national projects or programs.
The Seniority rule is an unwritten rule in both houses of Congress reserving the top posts in each chamber, particularly committee chairmanships, for members with the longest records of service. This rule is applied most strictly to the chairperson. The head of each committee is almost always the longest- serving member of the committee room the majority party. .
The seniority rule has many positive and negative sides to argue with. People insist that this system ignores ability and discourages younger members. This can be upsetting for the new younger members who have novel ideas that they wish to put into practice. This can also leave room for the seniors and their old views and ideas. This can cause the system to be biased with no fresh new objectives. This also leaves out people with initiative attitudes. .
This system is also said to be a rule that has a committee head that often comes from a "safe" constituency. This means that the head people comes from a state or district and frequently possess victories.
